SECTION 1 — DEFINITIONS
As used throughout these Terms, the following definitions apply. Defined terms appear in Title Case.
"Account" means the user profile and associated credentials created by you to access the Platform.
"Affiliate" means any entity that directly or indirectly controls, is controlled by, or is under common control with KinPet, Inc., including parent companies, subsidiaries, and related entities.
"Agreement" means these Terms of Service together with the Privacy Policy, Subscription Terms, and any additional policies incorporated by reference.
"AI Act" means Regulation (EU) 2024/1689 of the European Parliament and of the Council on Artificial Intelligence, and any implementing regulations or amendments thereto.
"App Store" means Apple App Store, Google Play Store, Huawei AppGallery, Samsung Galaxy Store, Amazon Appstore, or any other digital distribution platform through which the Application is made available.
"App Store Operator" means Apple Inc., Google LLC, Huawei Technologies Co., Ltd., Samsung Electronics Co., Ltd., Amazon.com, Inc., or any other operator of an App Store through which you obtained the Application.
"Application" or "App" means KinPet's mobile application(s) available on iOS, Android, or other operating systems, including all updates, upgrades, new versions, and related software.
"Billing Cycle" means the recurring period (monthly or annual) for which a Subscription fee is charged.
"Business Day" means a day other than a Saturday, Sunday, or public holiday in the State of Delaware, USA.
"Chargeback" means a transaction reversal initiated by a payment card issuer or payment processor at a cardholder's request.
"Content" means any text, images, photographs, videos, audio recordings, documents, data, information, feedback, messages, and other materials.
"Controller" has the meaning given under the GDPR and/or applicable data protection law, as the context requires.
"Data Protection Laws" means all applicable laws and regulations relating to the processing of personal data, including but not limited to: (i) the General Data Protection Regulation (EU) 2016/679 ("GDPR"); (ii) the UK General Data Protection Regulation and Data Protection Act 2018 ("UK GDPR"); (iii) the Lei Geral de Proteção de Dados (Brazil) ("LGPD"); (iv) the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and the Consumer Privacy Protection Act ("CPPA") if and when in force; (v) the Privacy Act 1988 (Australia); (vi) the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act ("CPRA"); and (vii) any other applicable national, state, or provincial data protection laws.
"Device" means any smartphone, tablet, computer, smartwatch, or other electronic device used to access the Platform.
"EEA" means the European Economic Area.
"Emergency" means any situation in which a pet may be experiencing a life-threatening condition or injury requiring immediate professional veterinary attention.
"EU" means the European Union and its member states.
"GDPR" means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, as amended or supplemented from time to time.
"Intellectual Property Rights" means all patents, utility models, rights to inventions, copyright and related rights, trademarks, service marks, trade names, domain names, rights in get-up and trade dress, goodwill, rights in designs, database rights, rights in confidential information including know-how and trade secrets, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights, and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
"Kin" means KinPet's proprietary AI-powered pet care companion and assistant, including all versions, models, updates, and improvements thereof, accessible via the Platform.
"Kin Credits" or "Credits" means the digital access units used within the Platform to access certain AI-powered features and functionalities, as further described in Section 7.
"KinPet", "we", "us", or "our" means KinPet, Inc., a Delaware corporation, and its Affiliates, successors, and assigns.
"Mandatory Local Law" means any provision of law applicable in your jurisdiction that cannot be excluded, modified, or waived by contract, including consumer protection statutes, data protection laws, and mandatory arbitration exemptions.
"Material Breach" means a fundamental breach of this Agreement that is so serious as to justify immediate termination and legal remedies, including but not limited to: unauthorized commercial exploitation of the Platform, fraudulent chargebacks, circumvention of security measures, uploading of malicious content, or violations of applicable law using the Platform.
"OCR" means optical character recognition technology used by PawScan to extract text from uploaded documents and images.
"PawScan" means KinPet's AI-powered document scanning, OCR processing, and health record organization feature.
"Personal Data" has the meaning given to it under applicable Data Protection Laws and generally means any information relating to an identified or identifiable natural person.
"Pet" means the companion animal(s) that you register and manage using the Platform.
"Platform" means collectively the Application, Website, Application Programming Interfaces (APIs), Kin AI companion, PawScan feature, Kin Credits system, reminder and notification systems, and all associated features, functionalities, content, and services provided by KinPet.
"Premium Plan" means a paid Subscription tier that provides access to enhanced features, as described on the Platform and subject to change per Section 6.
"Privacy Policy" means KinPet's Privacy Policy available at [privacy policy URL], which is incorporated into and forms part of this Agreement.
"Processing" has the meaning given under applicable Data Protection Laws.
"Processor" has the meaning given under applicable Data Protection Laws.
"SCCs" means the Standard Contractual Clauses for the transfer of personal data to third countries, as adopted or approved by the European Commission and/or the UK Information Commissioner's Office.
"Services" means all products, services, features, and functionalities made available by KinPet through the Platform.
"Standard Plan" means the free-tier access level of the Platform, subject to usage limitations described on the Platform.
"Subscription" means a paid recurring license to access Premium Plan features on a monthly or annual Billing Cycle basis.
"Subscription Fee" means the recurring fee charged for a Subscription, as displayed at the time of purchase and subject to change as provided in Section 6.
"Terms" or "Terms of Service" means this document, as amended from time to time.
"Third-Party Services" means any products, services, applications, websites, or content provided by parties other than KinPet that may be accessible through, linked to, or integrated with the Platform.
"UK" means the United Kingdom of Great Britain and Northern Ireland.
"User", "you", or "your" means the natural person or, where applicable, legal entity who accesses, installs, uses, or creates an Account on the Platform.
"User Content" means any Content that you submit, upload, post, transmit, or otherwise make available through the Platform, including pet records, documents, images, veterinary records, vaccination certificates, prescriptions, and health data.
"Veterinary Professional" means a licensed veterinarian, veterinary surgeon, veterinary technician, or other qualified animal health professional holding valid licensure under applicable law in the relevant jurisdiction.
"Website" means KinPet's official website(s), including any subdomains, microsites, or successor domains.
SECTION 2 — ACCEPTANCE OF TERMS
2.1 Binding Agreement. By performing any of the following actions, you enter into a legally binding Agreement with KinPet, Inc. and agree to be bound by these Terms in their entirety:
- Creating or registering an Account;
- Accessing, browsing, or using the Platform in any manner;
- Downloading, installing, or updating the Application;
- Purchasing a Subscription or Kin Credits;
- Using Kin or PawScan;
- Uploading User Content;
- Clicking any "I Agree," "Accept," "Sign Up," "Get Started," or similar button or checkbox; or
- Continuing to use the Platform after changes to these Terms are posted with notice.
2.2 Capacity to Contract. By accepting these Terms, you represent and warrant that you have the legal capacity to enter into a binding contract under the laws of your jurisdiction. If you are accepting these Terms on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement.
2.3 Non-Acceptance. If you do not agree to these Terms in their entirety, you must immediately cease using the Platform and uninstall the Application. Your continued use following notice of updated Terms constitutes acceptance of the updated Terms.
2.4 Precedence. In the event of a conflict between these Terms and any App Store Operator's terms and conditions, these Terms will govern with respect to KinPet's obligations and limitations. App Store Operator terms govern matters relating to App Store transactions and platform-specific policies.
SECTION 3 — ELIGIBILITY
3.1 Age Requirements. The Platform is intended for users who are:
- At least 18 years of age in most jurisdictions;
- At least 16 years of age in jurisdictions where GDPR Article 8 or equivalent local law sets a lower age of digital consent, and only where parental or guardian consent has been validly obtained;
- At least the age of digital majority in your jurisdiction, which may be higher than 18 in certain countries.
3.2 Prohibited Minor Use. KinPet does not knowingly permit users under the applicable age of majority to create Accounts, purchase Subscriptions, or use Kin Credits. If we discover that a user is under the applicable age, we will terminate the Account and, to the extent required by applicable law, delete associated data.
3.3 Geographic Availability. The Platform is not available to persons located in, ordinarily resident in, or nationals of jurisdictions subject to comprehensive U.S. economic sanctions or other applicable sanctions programs, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. We reserve the right to expand or modify this list at any time to comply with applicable sanctions law. See Section 28.5 for the complete Sanctions Policy.
3.4 Jurisdictional Restrictions. KinPet makes no representation that the Platform is appropriate, lawful, or available in all jurisdictions. Users who access the Platform from jurisdictions where doing so would be unlawful do so entirely at their own risk and are solely responsible for compliance with applicable local laws.
3.5 Business Accounts. Veterinary clinics, pet businesses, breeders, shelters, and other professional entities may use the Platform for internal pet management purposes only, subject to these Terms. Professional or enterprise licensing arrangements, if available, are governed by separate agreements. KinPet's Platform is not designed or certified for clinical or professional veterinary practice management.
SECTION 4 — THE PLATFORM AND SERVICES
4.1 Description of Services. KinPet provides a personal pet care management platform that includes: a digital pet profile and health record organizer, the Kin AI-powered pet care companion, the PawScan AI document scanning and OCR feature, reminder and notification systems for medications, vaccinations, and appointments, Kin Credits for accessing AI-powered features, and related digital tools for personal pet organization.
4.2 Nature of Services. THE PLATFORM IS A PERSONAL ORGANIZATION, INFORMATION, AND AI-ASSISTANCE TOOL ONLY. KINPET IS NOT A VETERINARY SERVICE PROVIDER, ANIMAL CLINIC, TELEMEDICINE PLATFORM, EMERGENCY SERVICE, PHARMACY, MEDICAL DEVICE, OR REGULATED HEALTH INFORMATION SYSTEM IN ANY JURISDICTION. NOTHING ON THE PLATFORM CONSTITUTES VETERINARY ADVICE, DIAGNOSIS, TREATMENT, OR PRESCRIPTION.
4.3 Availability. KinPet does not guarantee that the Platform will be available at all times, in all locations, or without interruption. We may modify, suspend, or discontinue the Platform or any feature thereof at any time with or without notice, subject to any mandatory notice obligations under applicable consumer protection laws.
4.4 Updates and Modifications. We reserve the right to update, modify, add, or remove features and functionality of the Platform at any time. Material changes to features included in paid Subscriptions will be communicated with reasonable notice.
4.5 Beta Features. Certain features may be released in beta or preview form. Beta features are provided "as is" and "as available" without any warranty whatsoever and are not covered by any service level commitments.
SECTION 5 — USER ACCOUNTS
5.1 Account Creation. To access most features of the Platform, you must create an Account by providing accurate, current, and complete information. You agree to keep your Account information updated at all times.
5.2 Account Security. You are solely responsible for maintaining the confidentiality and security of your Account credentials, including your password and any multi-factor authentication mechanisms. You agree to notify KinPet immediately at support@kinpet.com upon discovering or suspecting any unauthorized access to or use of your Account.
5.3 Account Responsibility. You are responsible for all activities that occur under your Account, whether or not authorized by you. KinPet shall not be liable for any loss or damage arising from unauthorized use of your Account resulting from your failure to maintain appropriate security measures.
5.4 One Account Per Person. Each natural person may maintain only one Account. Creating duplicate or multiple Accounts, particularly to circumvent suspension, credit limits, or other restrictions, constitutes a Material Breach.
5.5 Account Transfer. Accounts are personal and non-transferable. You may not sell, transfer, or assign your Account or any rights therein to any third party.
5.6 Accurate Information. You represent and warrant that all information you provide in connection with your Account is truthful, accurate, and complete. Providing false information, including a false date of birth to circumvent age restrictions, constitutes a Material Breach.
5.7 Deletion. You may delete your Account at any time through the Platform's account settings or by contacting us at support@kinpet.com. Account deletion does not automatically cancel active Subscriptions. You must cancel any active Subscription separately before or upon Account deletion. See Section 6 for Subscription cancellation procedures.
SECTION 6 — SUBSCRIPTIONS, PAYMENTS, AND BILLING
6.1 Subscription Plans. KinPet offers both a free Standard Plan and paid Premium Plan Subscriptions. Premium Plan Subscriptions are available on monthly or annual Billing Cycles. Current pricing, features, and Billing Cycle options are displayed within the Platform and on the Website, and are subject to change as provided in Section 6.9.
6.2 Automatic Renewal. ALL PAID SUBSCRIPTIONS RENEW AUTOMATICALLY AT THE END OF EACH BILLING CYCLE AT THE THEN-CURRENT SUBSCRIPTION FEE UNLESS CANCELLED BEFORE THE RENEWAL DATE. You authorize KinPet (or the applicable App Store Operator) to charge your designated payment method for each renewal period without further authorization from you.
6.3 Cancellation. You may cancel your Subscription at any time through:
- The Platform's account settings;
- Your App Store Operator's subscription management settings (for App Store purchases);
- Contacting KinPet support at support@kinpet.com.
Cancellation takes effect at the end of the current Billing Cycle. You will retain access to Premium Plan features until the end of the paid period. Deleting the Application does not cancel your Subscription. App Store Subscriptions must be cancelled through the applicable App Store.
6.4 Free Trials. If KinPet offers a free trial period, your payment method will be charged the applicable Subscription Fee automatically at the end of the free trial period unless you cancel before the trial ends. We will provide notice of the trial terms and duration at the time of signup.
6.5 Refund Policy — General. Except as expressly required by Mandatory Local Law or as specifically provided in these Terms, Subscription Fees and Kin Credit purchases are non-refundable. This includes situations where you fail to use Premium features during a paid period, decide to cancel mid-cycle, or are dissatisfied with AI outputs.
6.6 EU and UK Right of Withdrawal. Pursuant to Directive 2011/83/EU (Consumer Rights Directive) and the UK Consumer Contracts Regulations 2013:
- EU and UK consumers who purchase a Subscription directly through KinPet (not through an App Store) have a right to withdraw from the contract within 14 calendar days of the date of purchase without giving any reason (the "Withdrawal Period").
- By accessing Premium features during the Withdrawal Period, you expressly request that KinPet begin performing the digital service contract immediately, and you acknowledge that upon full performance of the contract, the right of withdrawal is lost. Partial performance during the Withdrawal Period will result in a proportional deduction from any refund.
- To exercise your right of withdrawal, you must notify KinPet at legal@kinpet.com or via the Platform before the Withdrawal Period expires, using a clear statement of your decision to withdraw.
- For Subscriptions purchased through Apple App Store or Google Play, the App Store Operator's refund policies govern, and you must seek refunds directly from the App Store Operator.
- The right of withdrawal does not apply to: (i) digital content that has been fully downloaded or streamed where performance began with your prior express consent and acknowledgment of loss of withdrawal right; or (ii) services fully performed within the Withdrawal Period.
6.7 Australian Consumer Guarantees. Pursuant to the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2), certain statutory guarantees apply to services supplied to Australian consumers that cannot be excluded. Where a service fails to meet a consumer guarantee, you may be entitled to a remedy. Nothing in these Terms excludes, restricts, or modifies those rights.
6.8 Payment Processing. Payments are processed through third-party payment processors. KinPet does not store complete payment card data. You agree to the terms of the applicable payment processor. For App Store purchases, payment processing is handled by the App Store Operator.
6.9 Price Changes. KinPet reserves the right to change Subscription Fees. We will provide at least 30 days' advance notice (or longer where required by applicable law) of any price increase via email and/or in-app notification. Price increases will take effect at the next renewal following the notice period. If you do not cancel before the price increase takes effect, you will be deemed to have accepted the new pricing. EU, UK, and Australian users will be given additional notice and cancellation rights as required by applicable consumer protection law.
6.10 Taxes. Subscription Fees are exclusive of applicable taxes unless expressly stated otherwise. You are responsible for all taxes, duties, levies, and governmental charges imposed on your use of the Platform in your jurisdiction, including but not limited to value-added tax (VAT), goods and services tax (GST), digital services taxes, and withholding taxes. Where KinPet is required by law to collect taxes, they will be added to your invoice.
6.11 Failed Payments. If your payment fails, we will attempt to process payment again and may temporarily suspend or downgrade your access to Premium features until payment is resolved. Repeated payment failures may result in Account suspension or termination.
6.12 App Store Purchases. For Subscriptions or Credits purchased through an App Store:
- The App Store Operator processes the payment and applicable refund requests;
- KinPet has no control over App Store refund decisions;
- App Store Operator terms and conditions govern the payment relationship;
- Apple App Store purchases are governed by Apple's Media Services Terms and Conditions;
- Google Play purchases are governed by Google Play's Terms of Service;
- You should direct billing issues for App Store purchases to the relevant App Store Operator.
6.13 Currency. Prices are displayed in U.S. Dollars (USD) unless local pricing is shown in your jurisdiction. If your payment is processed in a currency other than USD, exchange rate fluctuations may affect the USD equivalent. KinPet is not responsible for currency conversion fees charged by your bank or payment provider.
SECTION 7 — KIN CREDITS
7.1 Nature of Kin Credits. Kin Credits are digital access units used within the Platform to utilize certain AI-powered features, including Kin conversations and PawScan processing. Kin Credits are not currency, do not constitute legal tender, hold no cash value, and are not redeemable for money, property, or any service outside the Platform.
7.2 Credit Acquisition. Kin Credits may be acquired through: (i) the free Standard Plan allocation, if and as provided; (ii) paid Subscription Plans, which include a periodic Credit allocation; or (iii) direct purchase of Credit packages within the Platform or App Store.
7.3 Monthly Bonus Credits — Expiration. Monthly Bonus Credits allocated as part of a Subscription or promotional offer expire at the end of each Billing Cycle and do not roll over to subsequent cycles. Unused Monthly Bonus Credits are forfeited upon expiration and are not refundable.
7.4 Purchased Credits. Credits purchased as standalone packages (not Monthly Bonus Credits) expire as stated at the time of purchase, or if no expiration date is stated, within 24 months of purchase.
7.5 No Refunds on Credits. Kin Credits, once purchased, are non-refundable except as required by Mandatory Local Law. Credits consumed through AI processing, even if the output was unsatisfactory, are not refundable.
7.6 Credit Forfeiture. All Kin Credits, including purchased Credits, are immediately forfeited upon: (i) termination of your Account for Material Breach; (ii) voluntary Account deletion where termination is immediate; or (iii) Account suspension pending investigation of Material Breach.
7.7 No Transfer. Kin Credits are non-transferable between Accounts and may not be sold, gifted, or traded to other users.
7.8 Modification. KinPet reserves the right to modify Credit costs for features, adjust Credit allocations for Subscription Plans, or introduce new Credit-consuming features with reasonable prior notice. Material reductions in Credit value for paid Subscription holders will be communicated in advance.
7.9 EU/UK/Australia Note. The purchase of Kin Credits may be subject to statutory consumer protections in your jurisdiction. Please see Section 29 for jurisdiction-specific provisions.
SECTION 8 — KIN AI COMPANION
8.1 Nature of Kin. Kin is an AI-powered conversational assistant designed to help pet owners organize pet care information, understand general pet care concepts, and navigate the Platform. Kin is not a veterinarian, licensed animal health professional, medical device, telemedicine service, or clinical decision support system.
8.2 AI Limitations — Critical Disclosure. YOU UNDERSTAND AND ACCEPT THAT:
- Kin is powered by large language model and/or related AI technologies that are fundamentally probabilistic and may generate outputs that are incorrect, incomplete, outdated, misleading, or fabricated ("hallucinations");
- Kin may misinterpret symptoms, conditions, medications, dosages, species-specific needs, and clinical terminology;
- Kin does not have access to real-time information, current veterinary guidelines, or your pet's actual medical status unless explicitly provided by you;
- Kin's outputs do not constitute and must not be relied upon as veterinary advice, diagnosis, or treatment;
- Kin cannot detect emergencies with reliability and must never be used as a substitute for professional emergency assessment;
- Kin's suggestions regarding medications, dosages, supplements, or treatments may be incorrect and potentially harmful to your pet.
8.3 Mandatory Independent Verification. You are solely responsible for independently verifying any information, suggestion, interpretation, or output provided by Kin with a licensed Veterinary Professional before acting on it, particularly with respect to medications, dosages, diagnoses, treatment decisions, and emergency assessment.
8.4 Kin Classification Under EU AI Act. KinPet makes the following disclosure pursuant to the EU AI Act (Regulation (EU) 2024/1689): Kin is classified as a general-purpose AI system used in a consumer application context. Kin is not deployed as a high-risk AI system under Annex III of the AI Act. Kin is a transparency-tier system, and interactions with Kin clearly indicate that the user is communicating with an AI system. KinPet complies with applicable transparency obligations under the AI Act.
8.5 Feedback and Improvement. Conversations with Kin may be used, in anonymized and aggregated form, to improve KinPet's AI models and services, subject to our Privacy Policy and applicable Data Protection Laws.
8.6 Content Restrictions. You may not use Kin to: generate harmful, misleading, or deceptive content about pet health; attempt to elicit advice intended for human consumption; circumvent safety filters; or engage in activities prohibited under Section 17.
8.7 AI Model Evolution. The AI models powering Kin may change over time. KinPet does not guarantee consistency of outputs across model versions. Updates to Kin's AI models may alter its capabilities, limitations, or behavior.
SECTION 9 — PAWSCAN
9.1 Nature of PawScan. PawScan is an AI-powered document scanning and organization feature that uses OCR and related technologies to extract, interpret, and organize information from uploaded veterinary documents, medical records, prescriptions, vaccination certificates, and other pet-related documents.
9.2 OCR Limitations — Critical Disclosure. YOU UNDERSTAND AND ACCEPT THAT:
- OCR technology is imperfect and may misread, omit, transpose, or incorrectly interpret characters, numbers, names, and instructions;
- PawScan may incorrectly extract medication names, dosages (including critical decimal point errors), administration frequencies, dates, expiration dates, and veterinarian instructions;
- Handwritten documents, low-quality scans, damaged documents, and documents with non-standard formatting have significantly higher error rates;
- PawScan's AI interpretation layer may additionally introduce interpretive errors beyond raw OCR errors;
- Documents processed by PawScan are not verified against any authoritative database;
- Extracted information stored in the Platform may be inaccurate and should not be relied upon without verification against the original document.
9.3 Mandatory Verification. YOU MUST ALWAYS VERIFY PAWSCAN OUTPUTS AGAINST ORIGINAL SOURCE DOCUMENTS before relying on extracted information for any purpose, including but not limited to administering medications, scheduling treatments, or sharing information with veterinary professionals.
9.4 No Medical Record System. PawScan is not a certified electronic health record (EHR) system, a regulated medical device, or an official document repository. KinPet does not guarantee the integrity, accuracy, or completeness of any information stored through PawScan.
9.5 Document Retention. You are solely responsible for retaining original copies of all documents uploaded to PawScan. KinPet's obligation to retain uploaded documents is limited to the period of Account activity and as stated in the Privacy Policy. We do not guarantee long-term document preservation.
SECTION 10 — PET HEALTH DISCLAIMER
10.1 Not Veterinary Services. KINPET DOES NOT PROVIDE VETERINARY SERVICES, MEDICAL ADVICE, DIAGNOSIS, PROGNOSIS, TREATMENT, PRESCRIPTION, OR EMERGENCY CARE FOR ANIMALS IN ANY JURISDICTION. NOTHING ON THE PLATFORM, INCLUDING KIN'S OUTPUTS, PAWSCAN EXTRACTIONS, HEALTH RECORDS ORGANIZED THROUGH THE PLATFORM, OR ANY OTHER CONTENT OR FEATURE, CONSTITUTES OR SHOULD BE CONSTRUED AS VETERINARY ADVICE.
10.2 Not a Medical Device. The Platform is not a medical device under U.S. FDA regulations, EU Regulation (EU) 2017/745 (MDR), UK Medical Devices Regulations 2002, Australian Therapeutic Goods Act 1989, or equivalent applicable law in any jurisdiction.
10.3 Jurisdiction Variation. The legal definition of "veterinary practice" and what constitutes the unauthorized practice of veterinary medicine varies by country, state, and province. KinPet does not engage in veterinary practice in any jurisdiction and the Platform is designed exclusively as an organizational and AI-assistance tool.
10.4 Consult a Professional. You should always consult a licensed Veterinary Professional for any concerns about your pet's health, behavior, nutrition, medication, or wellbeing. Do not delay seeking professional veterinary care based on information obtained through the Platform.
SECTION 11 — EMERGENCIES
11.1 Not an Emergency Service. KINPET IS NOT AN EMERGENCY RESPONSE SERVICE AND MUST NOT BE USED IN EMERGENCY SITUATIONS INVOLVING YOUR PET. KIN CANNOT DETECT, DIAGNOSE, OR RESPOND TO VETERINARY EMERGENCIES.
11.2 Emergency Action Required. If you believe your pet is experiencing a medical emergency, you must immediately contact your local licensed emergency veterinary service, your regular veterinarian, or an emergency animal hospital.
11.3 International Emergency Resources. Emergency veterinary contact information varies by country. You are responsible for identifying and saving local emergency veterinary service contact information in your area. KinPet provides no guarantee regarding the accuracy or current availability of any third-party emergency service information that may be displayed in the Platform.
11.4 No Liability in Emergencies. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINPET SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY HARM, INJURY, ILLNESS, OR DEATH OF ANY ANIMAL ARISING FROM YOUR USE OF, OR RELIANCE ON, THE PLATFORM IN EMERGENCY OR TIME-SENSITIVE SITUATIONS.
SECTION 12 — REMINDERS, NOTIFICATIONS, AND ALERTS
12.1 Technology Limitations. Reminders, push notifications, and alerts provided through the Platform are organizational tools only. They may fail, be delayed, be incorrect, or not arrive due to: Device settings, operating system restrictions, network conditions, App Store policies, App Store Operator changes, server downtime, or software bugs.
12.2 No Guarantee. KINPET DOES NOT GUARANTEE THAT ANY REMINDER, NOTIFICATION, OR ALERT WILL BE DELIVERED ON TIME, IN ACCURATE FORM, OR AT ALL. KINPET SHALL NOT BE LIABLE FOR ANY HARM ARISING FROM MISSED, INCORRECT, OR DELAYED NOTIFICATIONS.
12.3 Backup Systems Required. For medication administration, vaccination schedules, and other time-critical pet care activities, you must maintain independent backup reminder systems. Do not rely exclusively on KinPet for medication compliance or time-sensitive care.
12.4 Permission Requirements. Notifications are subject to your Device's notification permissions settings. You are responsible for maintaining appropriate notification permissions on your Device. KinPet is not responsible for notification failures resulting from Device permission settings.
SECTION 13 — USER CONTENT
13.1 Your Responsibility. You are solely responsible for all User Content you submit, upload, or make available through the Platform. You represent and warrant that your User Content: (i) does not violate any applicable law or regulation; (ii) does not infringe any third-party Intellectual Property Rights; (iii) does not contain false or misleading information; (iv) does not contain malware, viruses, or harmful code; (v) does not violate any obligation of confidentiality; and (vi) relates to your own pet(s) or pets for which you have lawful authority to manage care records.
13.2 License Grant. By submitting User Content, you grant KinPet a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, process, reproduce, modify (for technical purposes such as formatting and compression), display, and distribute your User Content solely to the extent necessary to: (i) provide and maintain the Platform; (ii) comply with applicable law; and (iii) improve the Platform's features and AI models (in anonymized and aggregated form only).
13.3 Retention of Rights. You retain all ownership rights in your User Content. The license in Section 13.2 does not transfer ownership.
13.4 Prohibited Content. You may not upload, post, or transmit User Content that: contains pornography or sexually explicit material; glorifies animal abuse, neglect, or cruelty; constitutes hate speech or discrimination; identifies other individuals without their consent; constitutes spam or commercial solicitation; infringes third-party rights; or otherwise violates Section 17.
13.5 Content Monitoring. KinPet does not undertake to proactively monitor User Content but reserves the right to remove, disable, or moderate any User Content that violates these Terms, applicable law, or our content policies, at our sole discretion and without prior notice.
SECTION 14 — INTELLECTUAL PROPERTY
14.1 KinPet Ownership. The Platform, including all software, AI models, designs, graphics, user interfaces, text, logos, trademarks, service marks, trade names, and all other Content created by or for KinPet, is owned by or licensed to KinPet, Inc. and is protected by applicable Intellectual Property Rights under U.S. and international law.
14.2 Limited License to Users. Subject to your compliance with these Terms and payment of applicable fees, KinPet grants you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the Platform on your Device(s) for your personal, non-commercial pet care management purposes.
14.3 Restrictions. Except as expressly permitted by these Terms or applicable law, you may not: reverse engineer, decompile, disassemble, or attempt to extract the source code of the Platform; copy, modify, adapt, translate, or create derivative works based on the Platform; remove or alter any proprietary notices, labels, or marks; use any automated systems, bots, scrapers, or data mining tools on the Platform; resell, sublicense, or commercially exploit the Platform or any part thereof; or use KinPet's name, logo, or trademarks without prior written consent.
14.4 Feedback. If you provide KinPet with feedback, suggestions, or ideas regarding the Platform, you grant KinPet a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, implement, and incorporate such feedback into the Platform without compensation or attribution to you.
SECTION 15 — PRIVACY AND DATA PROTECTION
15.1 Privacy Policy. Your use of the Platform is governed by KinPet's Privacy Policy, which is incorporated into this Agreement by reference. The Privacy Policy describes how we collect, use, store, share, and protect your Personal Data, and explains your rights under applicable Data Protection Laws. Please read the Privacy Policy carefully.
15.2 Data Controller. For users in the EEA, UK, and Brazil, KinPet, Inc. acts as the data Controller for Personal Data processed through the Platform, subject to the details and qualifications set forth in the Privacy Policy.
15.3 Legal Basis for Processing. KinPet processes Personal Data on the following legal bases as applicable under GDPR, UK GDPR, and equivalent laws: (i) performance of contract; (ii) legitimate interests; (iii) compliance with legal obligations; and (iv) consent, where specifically obtained. Detailed bases by processing activity are set forth in the Privacy Policy.
15.4 Data Subject Rights. Depending on your jurisdiction, you may have rights including: access to your data; correction of inaccurate data; deletion of your data; restriction or objection to processing; data portability; and withdrawal of consent. See Section 29 for jurisdiction-specific rights and the Privacy Policy for exercise procedures.
15.5 Sensitive Data. Pet health data, while not regulated as human health data under most Data Protection Laws, is treated with heightened protection by KinPet given its sensitive nature. Details are set forth in the Privacy Policy.
SECTION 16 — DATA SECURITY
16.1 Security Measures. KinPet implements commercially reasonable technical and organizational measures to protect your Personal Data and User Content against unauthorized access, disclosure, alteration, and destruction.
16.2 No Absolute Security. No method of transmission over the internet or method of electronic storage is absolutely secure. KinPet does not guarantee the absolute security of your data and cannot warrant that security measures will prevent all unauthorized access.
16.3 Breach Notification. In the event of a data breach affecting your Personal Data, KinPet will notify you and applicable regulatory authorities as required by applicable Data Protection Laws, including within 72 hours of becoming aware of certain breaches under GDPR, within 72 hours under UK GDPR, and within applicable timeframes under LGPD and other applicable laws.
16.4 Your Security Responsibilities. You are responsible for maintaining the security of your Account credentials, your Device, and your network environment. You must use strong, unique passwords and enable available security features such as multi-factor authentication.
SECTION 17 — PROHIBITED CONDUCT
17.1 Prohibited Uses. You agree not to use the Platform to:
- Violate any applicable local, national, or international law or regulation;
- Engage in the unauthorized practice of veterinary medicine;
- Impersonate any person, entity, or organization;
- Upload, transmit, or distribute malware, viruses, spyware, or other harmful code;
- Attempt to gain unauthorized access to any part of the Platform, other user accounts, or KinPet's systems;
- Use automated tools, bots, scripts, or scrapers to access, collect, or extract data from the Platform without express written authorization;
- Circumvent, disable, or interfere with any security, access control, or rate-limiting features;
- Engage in denial-of-service attacks or otherwise interfere with Platform operations;
- Commercially exploit, resell, or sublicense access to the Platform or its outputs;
- Create multiple Accounts to circumvent usage limits, suspensions, or access restrictions;
- Engage in fraudulent chargebacks or payment disputes in bad faith;
- Upload content that promotes animal cruelty, abuse, or neglect;
- Collect or harvest Personal Data of other users without authorization;
- Use the Platform to process data of others in violation of applicable Data Protection Laws;
- Attempt to reverse engineer, decompile, or extract proprietary AI models or algorithms from the Platform;
- Use the Platform for any illegal purpose including tax evasion, money laundering, or sanctions circumvention; or
- Encourage or assist any other person in engaging in any of the above activities.
17.2 Consequences. Violation of this Section may result in immediate Account suspension or termination, forfeiture of Kin Credits, civil and/or criminal liability, and legal action by KinPet.
SECTION 18 — THIRD-PARTY SERVICES AND LINKS
18.1 Third-Party Services. The Platform may integrate with, link to, or facilitate access to Third-Party Services, including payment processors, App Store Operators, mapping services, and veterinary resource databases. KinPet does not own, control, or endorse Third-Party Services.
18.2 No Responsibility. KinPet is not responsible for the content, privacy practices, security, accuracy, or availability of Third-Party Services. Your interactions with Third-Party Services are governed by their respective terms and privacy policies.
18.3 Third-Party AI. Kin may be powered in whole or in part by third-party AI models or APIs. The use of such third-party AI services is subject to their respective terms and data processing agreements, the details of which are described in the Privacy Policy.
18.4 No Endorsement. Any reference to third-party products, services, organizations, or professionals on the Platform does not constitute an endorsement or recommendation by KinPet.
SECTION 19 — APP STORE SPECIFIC TERMS
19.1 Application. This Section applies to your use of the Application as obtained through an App Store.
19.2 App Store Operator Not a Party. You acknowledge that these Terms are between you and KinPet only, and not with any App Store Operator. App Store Operators are not responsible for the Application or its content.
19.3 Maintenance and Support. KinPet, not the App Store Operator, is responsible for maintenance and support of the Application as described in these Terms.
19.4 Warranty. In the event of a failure to conform to any applicable warranty, you may notify the App Store Operator, and to the maximum extent permitted by law, the App Store Operator will have no other warranty obligation with respect to the Application.
19.5 Product Liability. KinPet, not the App Store Operator, is responsible for addressing product liability, consumer protection, or similar claims relating to the Application.
19.6 Intellectual Property Infringement. KinPet, not the App Store Operator, is responsible for investigating, defending, settling, and resolving any third-party claim that the Application or your use of it infringes a third party's Intellectual Property Rights.
19.7 Apple-Specific Terms. If you obtained the Application through the Apple App Store: (i) the license granted in Section 14.2 is limited to a non-transferable right to use the Application on Apple-branded devices running iOS; (ii) Apple and its subsidiaries are third-party beneficiaries of these Terms, with the right to enforce these Terms against you as a third-party beneficiary.
19.8 Google-Specific Terms. If you obtained the Application through Google Play, you acknowledge that Google has no obligation to provide support or warranty for the Application.
SECTION 20 — DISCLAIMERS OF WARRANTIES
20.1 AS IS Disclaimer. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, SUITABILITY FOR VETERINARY PURPOSES, OR UNINTERRUPTED AVAILABILITY.
20.2 AI Outputs. KINPET SPECIFICALLY DISCLAIMS ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR FITNESS FOR ANY PURPOSE OF KIN'S AI-GENERATED OUTPUTS, PAWSCAN OCR EXTRACTIONS, OR ANY OTHER AI-PROCESSED CONTENT.
20.3 Pet Health Outcomes. KINPET MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING PET HEALTH OUTCOMES, THE EFFECTIVENESS OF ANY PET CARE APPROACH DISCUSSED ON THE PLATFORM, OR THE SUITABILITY OF ANY INFORMATION FOR ANY SPECIFIC PET.
20.4 Statutory Rights Preserved. Nothing in this Section excludes warranties that cannot be excluded under Mandatory Local Law, including but not limited to statutory guarantees under Australian Consumer Law and applicable EU and UK consumer rights legislation.
SECTION 21 — LIMITATION OF LIABILITY
21.1 Exclusion of Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINPET AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, PROPERTY DAMAGE, VETERINARY COSTS, PET INJURY, PET ILLNESS, OR PET DEATH, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
21.2 Cap on Direct Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINPET'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE GREATER OF: (i) THE TOTAL AMOUNTS PAID BY YOU TO KINPET IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (ii) ONE HUNDRED U.S. DOLLARS (USD $100.00).
21.3 Multiple Claims. The limitation in Section 21.2 applies to the aggregate of all claims, not to each individual claim.
21.4 Essential Basis. You acknowledge that the limitations of liability in this Section reflect a reasonable and fair allocation of risk and are an essential element of the basis of the bargain between you and KinPet. KinPet would not be able to provide the Platform at the stated pricing without these limitations.
21.5 Mandatory Local Law. Notwithstanding anything in this Section, nothing herein limits KinPet's liability for: (i) death or personal injury caused by KinPet's negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be limited or excluded under Mandatory Local Law, including under Australian Consumer Law, EU consumer rights legislation, UK consumer rights legislation, or applicable Brazilian consumer law (CDC — Código de Defesa do Consumidor).
SECTION 22 — INDEMNIFICATION
22.1 Your Indemnification Obligation. To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless KinPet, its Affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Platform; (ii) your User Content; (iii) your violation of these Terms; (iv) your violation of any applicable law; (v) your violation of any third-party rights; or (vi) your fraudulent, abusive, or illegal conduct in connection with the Platform.
22.2 Limitation. Section 22.1 does not apply to EU or UK consumers to the extent that it would impose obligations beyond those permitted under applicable consumer protection law. It does not apply in jurisdictions where consumer indemnification clauses are unenforceable.
22.3 KinPet Cooperation. KinPet will provide you with reasonable notice of any indemnifiable claim and cooperate reasonably in the defense thereof, at your expense.
SECTION 23 — TERM AND TERMINATION
23.1 Term. This Agreement commences on the date you first accept these Terms or use the Platform and continues until terminated.
23.2 Termination by You. You may terminate this Agreement at any time by deleting your Account and ceasing use of the Platform. Termination does not entitle you to a refund of any prepaid Subscription Fees except as required by Mandatory Local Law.
23.3 Termination by KinPet. KinPet may suspend or terminate your Account and access to the Platform at any time, with or without cause, with or without notice, subject to the following: (i) for Material Breach, termination may be immediate; (ii) for other causes, we will use reasonable efforts to provide advance notice where required by applicable law.
23.4 Effect of Termination. Upon termination: (i) all licenses granted to you under these Terms immediately cease; (ii) all Kin Credits are forfeited; (iii) your User Content may be deleted per the Privacy Policy; (iv) any active Subscription will end (for terminations initiated by KinPet without cause, any prepaid unused period may be refunded on a pro-rata basis); and (v) provisions of these Terms that by their nature should survive termination will survive.
23.5 Surviving Provisions. The following Sections survive termination: Section 1 (Definitions), Section 10 (Pet Health Disclaimer), Section 11 (Emergencies), Section 14 (Intellectual Property), Section 20 (Disclaimers), Section 21 (Limitation of Liability), Section 22 (Indemnification), Section 24 (Dispute Resolution), Section 25 (Governing Law), and Section 31 (General Provisions).
SECTION 24 — DISPUTE RESOLUTION AND ARBITRATION
24.1 Informal Resolution. Before filing any formal claim, the parties agree to attempt informal resolution. You must send a written notice describing your dispute to legal@kinpet.com. KinPet will attempt to resolve the dispute within 60 days. If the dispute is not resolved informally, either party may proceed per this Section.
24.2 Binding Arbitration — U.S. Users. For users located in the United States, all disputes, claims, or controversies arising out of or relating to these Terms or the Platform that are not resolved informally will be resolved through binding individual arbitration administered by JAMS under its applicable rules, except as provided in Section 24.5. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.
24.3 Class Action Waiver — U.S. Users. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST KINPET. Claims may only be brought in an individual capacity.
24.4 International Users — Dispute Resolution. For users located outside the United States:
- EU and UK users: Disputes will be subject to the jurisdiction provisions of Section 25. EU users may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. UK users may contact the relevant Alternative Dispute Resolution (ADR) scheme. The binding arbitration clause in Section 24.2 does not apply to EU or UK consumers to the extent that it would deprive them of the protection of mandatory consumer dispute resolution rights in their jurisdiction.
- Brazilian users: Disputes may be subject to Brazilian Consumer Protection Law (CDC) and relevant consumer arbitration or Procon mechanisms. The binding arbitration clause applies to the extent permitted by Brazilian law.
- Australian users: Australian Consumer Law rights and ACCC dispute resolution options are preserved. The binding arbitration clause applies to the extent permitted by Australian law.
- Canadian users: Disputes with Canadian consumers may be subject to applicable provincial consumer protection legislation.
24.5 Small Claims and Injunctive Relief. Notwithstanding Section 24.2, either party may bring claims in small claims court for eligible disputes, and either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
24.6 Arbitration Opt-Out. U.S. users may opt out of the binding arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@kinpet.com with the subject line "Arbitration Opt-Out" and your name and Account email. Opting out does not affect any other provision of these Terms.
24.7 Arbitration Costs. Arbitration fees will be allocated per JAMS rules. KinPet will pay arbitration fees for claims under USD $10,000 that are not determined to be frivolous. For frivolous or bad-faith claims, fees will be allocated as permitted by applicable law.
SECTION 25 — GOVERNING LAW AND JURISDICTION
25.1 U.S. Users. For users located in the United States, these Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
25.2 EU Users. For users located in the EU, these Terms are governed by the laws of the State of Delaware to the extent permitted by applicable law. Mandatory consumer protection provisions of the law of your EU member state of residence apply where they provide greater protection. For matters not subject to arbitration, you may bring proceedings in the courts of your member state of residence or in Delaware.
25.3 UK Users. For users located in the United Kingdom, these Terms are governed by the laws of England and Wales to the extent applicable, without prejudice to mandatory protections under UK consumer law. For matters not subject to arbitration, the courts of England and Wales have jurisdiction.
25.4 Brazilian Users. For users located in Brazil, mandatory provisions of Brazilian law apply, including the Consumer Defense Code (CDC — Lei nº 8.078/1990) and the LGPD (Lei nº 13.709/2018).
25.5 Australian Users. For users located in Australia, mandatory provisions of Australian law apply, including the Competition and Consumer Act 2010 (Cth) and the Privacy Act 1988 (Cth).
25.6 Other International Users. For users in all other jurisdictions, these Terms are governed by Delaware law, but mandatory consumer protection and data protection provisions of your local law apply where they provide greater protection.
SECTION 26 — INTERNATIONAL DATA TRANSFERS
26.1 Processing Location. KinPet processes Personal Data primarily in the United States. By using the Platform, you acknowledge that your Personal Data may be transferred to, stored in, and processed in the United States and other countries where KinPet or its service providers operate, which may have different data protection laws than your country of residence.
26.2 EEA and UK Transfers. For transfers of Personal Data from the EEA or UK to the United States or other third countries, KinPet relies on one or more of the following legal mechanisms as applicable: (i) Standard Contractual Clauses (SCCs) as adopted by the European Commission; (ii) UK International Data Transfer Agreements (IDTAs) or UK Addenda to EU SCCs as approved by the UK ICO; (iii) the EU-U.S. Data Privacy Framework (DPF) if and where applicable; or (iv) other appropriate safeguards under GDPR Article 46.
26.3 Brazilian Transfers. For transfers of Personal Data from Brazil, KinPet relies on applicable legal mechanisms under LGPD Article 33, including contractual clauses and compliance with ANPD standards.
26.4 Australian Transfers. For transfers of Personal Data from Australia, KinPet complies with Australian Privacy Principle 8 and applicable cross-border disclosure requirements under the Privacy Act 1988 (Cth).
26.5 EU Representative. As required by GDPR Article 27, KinPet has designated an EU representative. Contact details for KinPet's EU representative are available in the Privacy Policy.
26.6 UK Representative. As required by UK GDPR Article 27, KinPet has designated a UK representative. Contact details are available in the Privacy Policy.
SECTION 27 — GDPR AND UK GDPR SPECIFIC PROVISIONS
27.1 Applicability. This Section applies to users located in the EEA and UK whose Personal Data is processed by KinPet in connection with the Platform.
27.2 Data Subject Rights. Under GDPR and UK GDPR, you have the following rights with respect to your Personal Data:
- Right of Access (Article 15 GDPR): You may request a copy of the Personal Data we hold about you.
- Right to Rectification (Article 16 GDPR): You may request correction of inaccurate or incomplete Personal Data.
- Right to Erasure (Article 17 GDPR): You may request deletion of your Personal Data in certain circumstances.
- Right to Restriction of Processing (Article 18 GDPR): You may request that we restrict processing of your Personal Data in certain circumstances.
- Right to Data Portability (Article 20 GDPR): You may request a machine-readable copy of your Personal Data for transfer to another controller.
- Right to Object (Article 21 GDPR): You may object to processing based on legitimate interests or for direct marketing purposes.
- Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.
- Right not to be subject to solely automated decision-making (Article 22 GDPR): Subject to exceptions, you have the right not to be subject to decisions based solely on automated processing that produce significant legal or similar effects.
27.3 Exercising Rights. To exercise your GDPR or UK GDPR rights, contact KinPet's Data Protection contact at privacy@kinpet.com. We will respond within 30 days of receipt of your request.
27.4 Right to Lodge a Complaint. You have the right to lodge a complaint with your national Data Protection Authority (DPA). In the UK, this is the Information Commissioner's Office (ICO). Details of EEA DPAs are available at https://edpb.europa.eu/about-edpb/about-edpb/members_en.
27.5 Data Protection Officer. KinPet has appointed a Data Protection Officer (DPO) where required by applicable law. DPO contact details are available in the Privacy Policy.
SECTION 28 — U.S. SPECIFIC PROVISIONS
28.1 CCPA/CPRA — California Residents. California residents have specific rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know, the right to delete, the right to correct, the right to opt-out of the sale or sharing of personal information, and the right to limit use of sensitive personal information. KinPet does not sell personal information as defined under the CCPA. Details are set forth in the Privacy Policy.
28.2 Other U.S. State Privacy Laws. KinPet complies with applicable U.S. state privacy laws including those of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), and other states with comprehensive privacy legislation. Rights and remedies vary by state and are detailed in the Privacy Policy.
28.3 COPPA. The Platform is not directed to children under 13. KinPet does not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If you believe we have inadvertently collected such information, contact us immediately at privacy@kinpet.com.
28.4 CAN-SPAM and TCPA. KinPet's communications comply with the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA) as applicable.
28.5 Export Controls and Sanctions. The Platform and all services are subject to U.S. export control laws, including the Export Administration Regulations (EAR) and Office of Foreign Assets Control (OFAC) regulations. You may not use, export, re-export, or transfer the Platform in violation of U.S. export control laws. The Platform is not available to: (i) persons or entities on the U.S. Treasury Department's Specially Designated Nationals and Blocked Persons List or similar lists; (ii) persons or entities subject to comprehensive U.S. country-based sanctions programs, currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine; or (iii) any other person or entity prohibited under applicable U.S. sanctions law. This list may change and you are responsible for monitoring applicable sanctions programs.
SECTION 29 — JURISDICTION-SPECIFIC CONSUMER AND DATA PROTECTION PROVISIONS
29.1 Brazil — LGPD and Consumer Law.
- KinPet processes Personal Data of Brazilian users in compliance with the Lei Geral de Proteção de Dados (LGPD — Lei nº 13.709/2018).
- Legal bases for processing under LGPD include: execution of a contract, legitimate interests, and consent, as applicable.
- Brazilian users have rights under LGPD Article 18, including: confirmation of the existence of processing; access to data; correction of incomplete, inaccurate, or outdated data; anonymization, blocking, or deletion of unnecessary or excessive data; portability; deletion of data processed with consent; information about entities with which data has been shared; information about the possibility of refusing consent; and revocation of consent.
- Requests may be directed to privacy@kinpet.com.
- Brazilian users may also have rights under the Código de Defesa do Consumidor (CDC — Lei nº 8.078/1990), including rights regarding product liability and service quality that cannot be excluded by contract.
- In the event of conflict between these Terms and mandatory Brazilian consumer or data protection law, Brazilian mandatory law prevails.
29.2 Canada — PIPEDA/CPPA.
- KinPet processes Personal Data of Canadian users in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws (including PIPA in Alberta and BC, and the Act respecting the protection of personal information in the private sector in Quebec).
- Canadian users have the right to access their Personal Data held by KinPet and to request correction of inaccurate information by contacting privacy@kinpet.com.
- KinPet will comply with additional obligations under the Consumer Privacy Protection Act (CPPA/Bill C-27) upon its entry into force.
- Quebec Law 25 (Act to modernize legislative provisions as regards the protection of personal information) obligations apply to KinPet's processing of Personal Data of Quebec residents.
29.3 Australia — Privacy Act and Consumer Law.
- KinPet processes Personal Data of Australian users in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
- Australian users have the right to access and request correction of Personal Data by contacting privacy@kinpet.com.
- If you are not satisfied with KinPet's handling of your privacy complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at https://www.oaic.gov.au.
- Certain guarantees and rights under the Australian Consumer Law (ACL, being Schedule 2 of the Competition and Consumer Act 2010 (Cth)) apply to services supplied by KinPet to Australian consumers and cannot be excluded. To the extent permitted by the ACL, KinPet limits its liability for failure to comply with a consumer guarantee to: re-supplying the services, or paying the cost of having the services re-supplied.
- Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the ACL that cannot be lawfully excluded or limited.
29.4 European Union — Additional Consumer Rights.
- EU consumers benefit from mandatory protections under EU consumer law, including but not limited to: Directive 2011/83/EU (Consumer Rights Directive), Directive 2005/29/EC (Unfair Commercial Practices Directive), and Directive 93/13/EEC (Unfair Terms in Consumer Contracts Directive).
- Where any term of these Terms is deemed unfair under the Unfair Terms in Consumer Contracts Directive or applicable national implementing legislation, such term shall be without effect to that extent only, and the remaining terms shall continue in force.
- The right of withdrawal described in Section 6.6 applies to EU consumers as required by Directive 2011/83/EU.
- EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
29.5 United Kingdom — Additional Consumer Rights.
- UK consumers benefit from protections under the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and Unfair Terms in Consumer Contracts Regulations 1999 (as applicable).
- The right of withdrawal described in Section 6.6 applies to UK consumers as required by the Consumer Contracts Regulations 2013.
- UK consumers may contact Citizens Advice for guidance on consumer rights at https://www.citizensadvice.org.uk.
SECTION 30 — ARTIFICIAL INTELLIGENCE — REGULATORY COMPLIANCE
30.1 EU AI Act Compliance. KinPet is committed to compliance with the EU AI Act (Regulation (EU) 2024/1689) as applicable. In connection with Kin:
- Kin clearly discloses to users that they are interacting with an AI system in compliance with the AI Act's transparency requirements.
- Kin does not utilize prohibited AI practices under Chapter II of the AI Act.
- KinPet does not classify Kin as a high-risk AI system under Annex III of the AI Act. KinPet monitors regulatory guidance for any updates to this classification.
- Where Kin generates synthetic content, KinPet implements applicable disclosure mechanisms.
- KinPet maintains appropriate technical documentation as required by applicable AI Act obligations.
30.2 AI Transparency. KinPet is committed to transparency regarding Kin's AI nature. The Platform will always make clear to users when they are interacting with AI-generated content or an AI system.
30.3 Human Oversight. KinPet recommends that users exercise independent human judgment and consult licensed professionals when making decisions based on Kin's outputs, particularly regarding pet health. AI outputs are informational aids only.
30.4 AI Model Improvements. KinPet continuously works to improve Kin's accuracy, safety, and reliability. However, AI technology inherently involves limitations, and KinPet cannot guarantee error-free performance.
SECTION 31 — GENERAL PROVISIONS
31.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional policies incorporated by reference, constitute the entire agreement between you and KinPet with respect to the Platform and supersede all prior and contemporaneous agreements, understandings, negotiations, and communications, whether written or oral.
31.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these Terms, and the remaining provisions will continue in full force and effect.
31.3 Waiver. No failure or delay by KinPet in exercising any right, power, or remedy under these Terms will operate as a waiver of that right. No single or partial exercise of any right, power, or remedy precludes any other or further exercise of such right or the exercise of any other right.
31.4 Assignment. You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without KinPet's prior written consent. KinPet may freely assign these Terms and its rights and obligations hereunder to any Affiliate, successor, or acquirer without your consent. These Terms will be binding upon and inure to the benefit of the parties and their permitted successors and assigns.
31.5 Force Majeure. KinPet shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, government actions, regulatory changes, internet or telecommunications failures, cyberattacks, pandemics, or App Store Operator policy changes.
31.6 Notices. KinPet may provide notices to you via: email to the address on your Account; in-app notifications; push notifications to your Device; or posting on the Website or Platform. Notices are effective when sent or, if posted on the Platform or Website, when available. You may provide notices to KinPet at the contact information in Section 32.
31.7 Relationship of the Parties. Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and KinPet. You have no authority to bind KinPet in any way.
31.8 Updates to Terms. KinPet reserves the right to update these Terms at any time. We will notify you of material changes by: updating the "Last Updated" date at the top of these Terms; sending an email to your Account email address; and/or providing an in-app notification. If you continue to use the Platform after the effective date of updated Terms, you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and, if applicable, cancel your Subscription.
31.9 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
31.10 Language. These Terms are drafted in English. In the event of any inconsistency or conflict between an English version and any translated version, the English version shall prevail to the maximum extent permitted by applicable law. Where applicable law in your jurisdiction (such as Quebec's Charter of the French Language or Brazil's requirement for Portuguese) requires that contracts be provided in a specific language, the version in that language, where provided, shall govern for users in that jurisdiction.
31.11 No Third-Party Beneficiaries. Except as expressly stated (e.g., Apple as a third-party beneficiary per Section 19.7), these Terms do not create any third-party beneficiary rights.
31.12 Electronic Communications. You consent to receive communications from KinPet electronically, including via email and in-app notifications. You agree that these electronic communications satisfy any applicable legal requirement that communications be in writing, to the extent permitted by applicable law.
31.13 Accessibility. KinPet is committed to improving accessibility for users with disabilities. If you encounter accessibility barriers on the Platform, please contact us at support@kinpet.com.
